By accessing this website or purchasing or using any services or digital products from MindfulBxBursts, you agree to these terms & conditions (“terms”). If you do not agree, please do not use this website.

 

1) Scope of services

MindfulBxBursts provides behavior-analytic education, caregiver and educator coaching, consultation services, and digital resources.

Virtual services: Behavior consultations are provided virtually only.
Limited in-person exception(s): In-person services may be available only when contracted for professional development or other educational services for organizations. Any in-person engagement requires a separate written agreement outlining scope, location, fees, travel terms (if applicable), and cancellation terms specific to the event.

 

2) Educational services only, not therapy or emergency services

Services and materials offered by MindfulBxBursts are educational and consultative coaching. They are not therapy, not emergency services, and not a substitute for medical, mental health, or crisis care.

Recommendations are general and based on the information you share. Results are not guaranteed, and you choose what to implement. If you are in immediate danger or need urgent help, call 911 or go to the nearest emergency room.

 

3) No guarantee of outcomes

Behavior change is influenced by many variables. MindfulBxBursts does not guarantee specific outcomes, results, or timelines from coaching, consultation, or use of any resources.

 

4) Booking, participation, and client responsibilities

When you book a service with MindfulBxBursts, you agree that:

  • You will provide accurate and complete information relevant to your goals and context.

  • You understand recommendations are educational in nature and may require adaptation and ongoing review.

  • You are responsible for implementation decisions.

Accessing this website or sending a message does not create a professional-client relationship. A professional relationship begins only after booking is confirmed and any required intake forms and agreements are completed.

 

5) Minors

Services and materials are intended for adults. If services relate to a minor, the adult participant must be the parent or legal guardian or have legal authority to consent. MindfulBxBursts may require written confirmation.

 

6) Fees and payment

Prices are listed on the website and may change at any time. You agree to pay all fees and applicable taxes at the time of purchase. If a payment fails, MindfulBxBursts may pause delivery of services or access to materials until payment is resolved.

 

7) Cancellation and rescheduling policy for bookings

By booking a session, you agree to the following cancellation and rescheduling terms:

  • More than 24 hours’ notice: reschedule at no charge.

  • Less than 24 hours’ notice: the session fee is non-refundable and is charged in full.

  • Emergencies: if something unexpected happens within 12 hours, you may request one courtesy reschedule (one time per client). If approved, the rescheduled session must occur within 30 days.

  • No-shows: not eligible for reschedule or refund.

Late arrivals: If you are running late, the session will still end at the scheduled end time. The remaining time in your scheduled session window will be used.

MindfulBxBursts reserves the right to make the final determination regarding courtesy reschedules.

 

8) Digital products, delivery, and refunds

MindfulBxBursts sells digital resources directly through Wix. After purchase, access or delivery is provided as described on the product page or within your order confirmation.

Due to the nature of digital products and instant access, all digital product sales are final and non-refundable, except where required by law or if the file is defective and cannot be delivered. If you experience a delivery issue, contact us at drlandry@mindfulbxbursts.com and we will make reasonable efforts to resolve access or file delivery.

 

9) Digital product license and permitted use

Unless otherwise stated on the product listing, digital products are licensed for personal use by one individual (or one classroom or one site if a listing explicitly states an educator or site license).

You may not share, resell, redistribute, upload to shared drives, or use the materials to create competing products. You may print copies for your own use consistent with the license purchased.

 

10) Intellectual property

All content on this website and in MindfulBxBursts materials, including text, graphics, logos, downloads, templates, videos, and other resources, is owned by MindfulBxBursts or used with permission and is protected by intellectual property laws. You may not use content beyond what is permitted under the license or without written permission.

 

11) Acceptable use of the website

You agree not to use the website in a way that could damage, disable, overburden, or impair it, or interfere with anyone else’s use. You agree not to attempt unauthorized access to systems, accounts, or data.

 

12) Testimonials and examples

Testimonials and examples reflect individual experiences and do not guarantee that you will achieve similar results.

 

13) Third-party tools and links

This website may include third-party tools or links (including payment processing and scheduling). MindfulBxBursts is not responsible for third-party content, policies, or practices. Your use of third-party services is subject to their terms.

To the fullest extent permitted by law, MindfulBxBursts will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the website, services, or products.

To the fullest extent permitted by law, MindfulBxBursts’ total liability for any claim related to services or products will not exceed the amount you paid to MindfulBxBursts for the specific service or product giving rise to the claim.

 

17) Indemnification

You agree to indemnify and hold harmless MindfulBxBursts from any claims, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of your use of the website, violation of these terms, or infringement of any rights of a third party.

 

18) Termination

MindfulBxBursts reserves the right to refuse service, terminate access, or cancel orders if there is misuse, harassment, non-payment, fraud, or violation of these terms. Any fees already paid will be handled in accordance with the policies above and applicable law.

 

19) Governing law and venue

These terms are governed by the laws of the State of Louisiana, without regard to conflict of law principles. Any dispute arising from these terms, services, or products will be brought in the state or federal courts located in Terrebonne Parish, Louisiana, unless otherwise required by law.

 

20) Changes to these terms

MindfulBxBursts may update these terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of the website after changes means you accept the revised terms.
